فَإِنْ جُعِلَ لَهُ مَعَهُ دِرهَمًا وَنَحْوَهُ لَمْ يَصِحَّ،

مطالب أولي النهىal-Ruhaybani
(فَإِنَّ جَعَلَ لَهُ مَعَهُ) - أَيْ الْجُزْءِ (دِرْهَمًا وَنَحْوَهُ) كَدِينَارٍ؛ (لَمْ يَصِحَّ) نَصًّا، سُئِلَ أَحْمَدُ عَنْ الرَّجُلِ يُعْطِي الثَّوْبَ بِالثُّلُثِ وَدِرْهَمٍ وَدِرْهَمَيْنِ، قَالَ: أَكْرَهُهُ؛ لِأَنَّ هَذَا شَيْءٌ لَا يُعْرَفُ، وَالثُّلُثُ إذَا لَمْ يَكُنْ مَعَهُ شَيْءٌ نَرَاهُ جَائِزًا.
