(وإن عقد) السلم (ببرية أو بحر شرطاه) أي: مكان الوفاء لزوما وإلا فسد السلم؛ لتعذر الوفاء موضع العقد، وليس بعض الأماكن سواه أولى من بعض، فاشترط تعيينه بالقول كالكيل، ويقبل قول المسلم إليه في تعيينه مع يمينه،
