(ولا تفتقر) زوجة المفقود (إلى حكم حاكم بضرب المدة) أي: مدة التربص (وعدة الوفاة) كما لو قامت البينة وكمدة الإيلاء، ولا تفتقر أيضا إلى طلاق ولي زوجها.
