(وَمِلْكِهِ) أَيْ الْيَتِيمِ (لِمَا بِيعَ) أَيْ أُرِيدَ بَيْعُهُ لِاحْتِمَالِ كَوْنِهِ مِلْكَ غَيْرِهِ

ثَالِثُها قوله: وملكه لما بيع يعني أنه يشترط لجواز بيع الحاكم مع الشرطين المتقدمين أن يثبت عنده أن هذا الذي يريد بيعه ملك لليتيم، فمعنى بيع قصد بيعه.
