(وَعَكْسُهُ) أَيْ صَرِيحُ الطَّلَاقِ، وَكِنَايَتُهُ كِنَايَةُ إعْتَاقٍ لِمَا مَرَّ، فَقَوْلُهُ لِرَقِيقِهِ: طَلَّقْتُك أَوْ أَنْتِ خَلِيٌّ أَوْ نَحْوَ ذَلِكَ إنْ نَوَى الْعِتْقَ عَتَقَ وَإِلَّا فَلَا. نَعَمْ قَوْلُهُ لِعَبْدِهِ: اعْتَدَّ أَوْ اسْتَبْرِئْ رَحِمَك لَغْوٌ لَا يَعْتِقُ بِهِ وَإِنْ نَوَاهُ لِاسْتِحَالَةِ ذَلِكَ فِي حَقِّهِ،
