(ويصالح بها عن دم عمد، أو يعتق عليها عبداً) ؛ لأن الشفعة إنما تجب في مبادلة المال بالمال، وهذه الأعواض ليست بمال؛ فإيجاب الشفعة فيها خلاف المشروع وقلب الموضوع، قيد الصلح عن الدم بالعمد لأن الخطأ عوضه مال فتجب فيه الشفعة
