قَوْلُهُ: (وَإِذَا مَاتَ الْمُشْتَرِي لَمْ تَسْقُطْ) لِأَنَّ الْمُسْتَحِقَّ لَهَا بَاقٍ وَلَا تُبَاعُ فِي دَيْنِ الْمُشْتَرِي وَوَصِيَّتِهِ فَإِنْ بَاعَهَا الْقَاضِي، أَوْ الْوَصِيُّ، أَوْ أَوْصَى بِهَا الْمُشْتَرِي فَلِلشَّفِيعِ أَنْ يُبْطِلَ ذَلِكَ كُلَّهُ وَيَأْخُذَ الدَّارَ لِتَقَدُّمِ حَقِّهِ.
