(فإذا عمرت) وانقضت مدة إجارتها (ردها إلى من له السكنى) ؛ لأن في ذلك رعاية الحقين حق الواقف بدوام صدقته، وصاحب السكنى بدوام سكناه؛ لأنه لو لم يعمرها تفوت السكنى أصلا، وبالإجارة تتأخر، وتأخير الحق أولى من فواته.
