(ولا يقع طلاق مولاه على امرأته) : أي امرأة العبد، لأنه لا حق له في نكاحه.

(وَلَا يَقَعُ طَلَاقُ مَوْلَاهُ عَلَى امْرَأَتِهِ) لِقَوْلِهِ - عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ - «الطَّلَاقُ بِيَدِ مَنْ مَلَكَ السَّاقَ» وَلِأَنَّ الْحِلَّ حَصَلَ لِلْعَبْدِ فَكَانَ رَفْعُهُ إلَيْهِ.
