(ومن ورث قصاصا على أبيه) أي أصله سقط، ولا يستوفى القصاص إلا بالسيف،

وإذا قتل المكاتب عمداً وليس له وارثٌ إلا المولي وترك وفاءً فله القصاص؛

فإن ترك وفاءً ووارثه غير المولي فلا قصاص لهم،
