(وقال أبو حنيفة: يأخذ ذلك) أي الثلث (من الأم، فإن فضل) من الثلث (شيء أخذه من الولد) لأن الأم أصل في العقد، فكان في التنفيذ، واختار قول الإمام البرهاني والنسفي وغيرهما، تصحيح.
