(قَوْلُهُ وَالْغَارِمُ مَنْ لَزِمَهُ دَيْنٌ) أَيْ يُحِيطُ بِمَالِهِ أَوْ لَا يَمْلِكُ نِصَابًا فَاضِلًا عَنْ دَيْنِهِ

وَكَذَا إذَا كَانَ لَهُ دَيْنٌ عَلَى غَيْرِهِ لَمْ يَكُنْ بِهِ غَنِيًّا سَوَاءٌ كَانَ نِصَابًا أَوْ أَكْثَرَ لِأَنَّهُ لَمْ يَكُنْ بِذَلِكَ غَنِيًّا.
