(وَشُرُوطُهُ) أَيْ اسْتِيفَاءِ الْقِصَاصِ (ثَلَاثَةٌ أَحَدُهَا: تَكْلِيفُ مُسْتَحِقِّهِ) ; لِأَنَّ غَيْرَ الْمُكَلَّفِ لَيْسَ أَهْلًا لِلِاسْتِيفَاءِ وَلَا تَدْخُلُهُ النِّيَابَةُ لِمَا يَأْتِي
