شرح منتهى الإراداتal-Buhuti

(وَيَنْتَقِلُ حَقُّ الْقَوَدِ مِنْ مُورِثِهِ) أَيْ الْمَنْقُولِ (إلَيْهِ) أَيْ إلَى الْوَارِثِ ; لِأَنَّهُ بَدَلُ نَفْسِ الْمَقْتُولِ كَالدِّيَةِ

معونة أولي النهىIbn al-Najjar

(وينتقل) حق القود (من مورثه) الذي هو المقتول (إليه) أي: إلى وارثه على الأصح، لأن القود بدل عن نفس المقتول كالدية. وقد تقدم في الوصايا صحة إيصائه بديته، وأنه يقضى منها ديونه، كسائر ماله.
