(فَإِنْ خِيفَ) إنْ اقْتَصَّ مِنْ مَنْكِبٍ جَائِفَةً (فَلَهُ أَنْ يَقْتَصَّ مِنْ مِرْفَقِهِ) ; لِأَنَّهُ أَخَذَ مَا أَمْكَنَهُ مِنْ حَقِّهِ
