شرح منتهى الإراداتal-Buhuti

(وَلَا يُشْتَرَطُ كَوْنُهَا) أَيْ الْقَسَامَةِ (بِقَتْلٍ عَمْدٍ) لِأَنَّهَا حُجَّةٌ شَرْعِيَّةٌ فَوَجَبَ أَنْ يَثْبُتَ بِهَا الْخَطَأُ كَالْعَمْدِ.

معونة أولي النهىIbn al-Najjar

(ولا يشترط كونها) أي: كون القسامة (بقتل عمد) ؛ لأن القسامة حجة شرعية. فوجب أن يثبت بها الخطأ؛ كالعمد.
