(فَلَوْ نَقَصَتْ) قِيمَةُ مَسْرُوقٍ (بَعْدَ إخْرَاجِهِ قُطِعَ) لِوُجُودِ النَّقْصِ بَعْدَ السَّرِقَةِ كَمَا لَوْ نَقَصَتْ قِيمَتُهُ بِاسْتِعْمَالِهِ وَ

(فلو نقصت) قيمة المسروق (بعد إخراجه: قُطع) ولم يكن ذلك مسقطاً للقطع، لأن النقصان وجد في العين بعد سرقتها. أشبه ما لو نقصت قيمتها باستعماله إياها.
