(وَإِنْ قَتَلَ) مُحَارِبٌ (فَقَطْ لِقَصْدِ الْمَالِ قُتِلَ حَتْمًا وَلَمْ يُصَلَّبْ) لِمَا تَقَدَّمَ عَنْ ابْنِ عَبَّاسٍ، وَلِأَنَّ جِنَايَتَهُمْ بِالْقَتْلِ وَأَخْذِ الْمَالِ تَزِيدُ عَلَى جِنَايَتِهِمْ بِالْقَتْلِ وَحْدَهُ فَوَجَبَ اخْتِلَافُ الْعُقُوبَتَيْنِ
