(وَإِنْ كَانَ الْحَقُّ عَيْنًا) كَعَارِيَّةٍ أَوْ وَدِيعَةٍ (فَوُهِبَتْ لَهُ) أَيْ الْغَرِيمِ الْحَالِفِ (وَقَبِلَ) الْهِبَةَ (حَنِثَ) بِفِرَاقِهِ لِتَرْكِهِ الْوَفَاءَ بِاخْتِيَارِهِ وَ
