(وَيَجْلِسُ) الْكَاتِبُ (بِحَيْثُ يُشَاهِدُ) الْقَاضِي (مَا يَكْتُبُهُ) ; لِأَنَّهُ أَمْكَنُ لِإِمْلَائِهِ عَلَيْهِ وَأَبْعَدُ لِلتُّهْمَةِ،
