(وَيُسَنُّ تَكْرَارُهُ ثَلَاثًا) فَإِنْ أَجَابَ وَإِلَّا قَضَى عَلَيْهِ ; لِأَنَّهُ نَاكِلٌ عَمَّا تَوَجَّهَ إلَيْهِ مِنْ الْجَوَابِ فَيُحْكَمُ عَلَيْهِ بِالنُّكُولِ عَنْهُ كَالنُّكُولِ عَنْ الْيَمِينِ
