وَإِنْ سَأَلَ الْمُدَّعَى عَلَيْهِ الْحَاكِمَ كِتَابَةَ مَحْضَرٍ مِمَّا جَرَى إيجَابُهُ وَذَكَرَ فِيهِ أَنَّهُ بَقَّى الْعَيْنَ بِيَدِهِ ; لِأَنَّهُ لَمْ يَثْبُتْ مَا يَرْفَعُهَا

معونة أولي النهىIbn al-Najjar

(وإن سأل المدّعَى عليه الحاكم كتابةَ مَحضرٍ بما جرى: أجابه) وجوباً، (وذكر فيه) أي: في المحضر: (أنه) أي: أن الحاكم (بقَّى العين بيده؛ لأنه لم يثُبت ما يرفعُها) أي: ما يرفع يده عنها.
