(فَإِنْ نَكَلَ) عَنْ الْيَمِينِ لِلْآخَرِ (أَخَذَ مِنْهُ بَدَلَهَا) أَيْ الْعَيْنِ بِالْحُكْمِ بِنُكُولِهِ،
