شرح منتهى الإراداتal-Buhuti

(وَإِلَّا) يَكُنْ مُزَكَّوْنَ فَحَاكِمٌ (أَوْ كَانُوا) أَيْ الْمُزَكُّونَ (فَسَقَةً فَحَاكِمٌ) يَضْمَنُ لِحُصُولِ التَّلَفِ بِفِعْلِهِ وَهُوَ حُكْمُهُ. وَقَدْ فَرَّطَ بِتَرْكِهِ التَّزْكِيَةَ

معونة أولي النهىIbn al-Najjar

(وإلا) أي: وإن لم يكن مزكون، (أو كانوا) أي: كإن المزكون (فسقة: فحاكم) أي: فيكون الضمان على الحاكم، لأن التلف حصل بفعله وهو حكمه. فلزمه الضمان؛ لتفريطه بتركه التزكية.
