(وَيُحَطُّ ثَمَنُهُ إنْ لَمْ يُؤْخَذْ) أَيْ إنْ لَمْ يَكُنْ بَائِعُهُ أَخَذَهُ مِنْ الْمَيِّتِ (مِنْ تَرِكَةِ) مَيِّتٍ كَسَائِرِ دُيُونِهِ
