(وَ) الْمَيِّتُ (الْمُتَعَذِّرُ إخْرَاجُهُ مِنْ بِئْرٍ إلَّا مُتَقَطِّعًا وَنَحْوَهُ) كَمُمَثَّلٍ بِهِ (وَثَمَّ حَاجَةٌ إلَيْهَا) أَيْ الْبِئْرِ (أُخْرِجَ) مُتَقَطِّعًا لِأَنَّهُ أَقَلُّ ضَرَرًا مِنْ طَمِّهَا

(و) الميت (المتعذَّر إخراجه من بئر إلا متقطّعاً ونحوه وثََََمْ حاجة إليها) أي: إلى البئر (أخرج) متقطعاً " لأن الضرر الحاصل بمُثلة الميت أخف ضرراً من الضرر الحاصل بالحاجة إلى البئر.
