(وَهُوَ) أَيْ الْخَرَاجُ (عَلَى الْمَالِكِ) لِأَنَّهُ عَلَى رَقَبَةِ الْأَرْضِ دُونَ مُسْتَأْجِرِهَا كَفِطْرَةِ رَقِيقٍ
