(وَلَا أَرْشَ) لِمَغْبُونٍ (مَعَ إمْسَاكِ) مَبِيعٍ ; لِأَنَّ الشَّرْعَ لَمْ يَجْعَلْهُ لَهُ وَلَمْ يَفُتْ عَلَيْهِ جُزْءٌ مِنْ مَبِيعٍ يَأْخُذُ الْأَرْشَ فِي مُقَابَلَتِهِ
