(وَإِنْ بَاعَ سِلْعَةً بِدُونِ ثَمَنِهَا) الَّذِي اشْتَرَاهَا بِهِ (عَالِمًا) بِالنَّقْصِ عَنْ ثَمَنِهَا (لَزِمَهُ) الْبَيْعُ فَلَا خِيَارَ لَهُ

(وإن باع) السلعة (بدون ثمنها) أي: رأس مالها (عالماً بذلك) أي: بالنقص عن رأس مالها: (لزمه) أي: البائع البيع. فلا يثبت له خيار.
