شرح منتهى الإراداتal-Buhuti

(وَلَوْ سَلَّمَهُ) أَيْ الْمَبِيعَ بَعْضُهُ بَائِعٌ (بِلَا إذْنِهِ) أَيْ الشَّرِيكِ (فَالْبَائِعُ غَاصِبٌ) لِنَصِيبِ شَرِيكِهِ لِتَعَدِّيهِ عَلَيْهِ (وَقَرَارُ الضَّمَانِ) فِيهِ إنْ تَلِفَ (عَلَى مُشْتَرٍ إنْ عَلِمَ) أَنَّ لَهُ فِيهِ شَرِيكًا لَمْ يَأْذَنْ

معونة أولي النهىIbn al-Najjar

(ولو سلمه) البائع (بلا إذنه) أي: الشريك (فالبائع غاصب) ؛ لتعديه. (وقرار الضمان) فيما إذا تلف (على مشتر: إن علم) أن له فيه شريكاً لم يأذن.
