شرح منتهى الإراداتal-Buhuti

(فَلَا يَصِحُّ إبْدَالُهَا) إذَا وَقَعَ الْعَقْدُ عَلَى عَيْنِهَا لِتَعَيُّنِهَا (وَيَصِحُّ تَصَرُّفُهُ) أَيْ مَنْ صَارَتْ إلَيْهِ (فِيهَا) قَبْلَ قَبْضِهَا كَسَائِرِ أَمْلَاكِهِ.

(فلا يصح إبدالها) ؛ لأن العقد وقع على عينها. (ويصح تصرفه فيها) قبل القبض؛ كسائر أملاكه.
