(وَلَا يَلْزَمُهُمَا) أَيْ مَالِكَ الْأَصْلِ وَمَالِكَ الْأَرْضِ (قَطْعُ) ثَمَرَةٍ أَوْ زَرْعٍ (شُرِطَ) فِي الْبَيْعِ ; لِأَنَّ الْأَصْلَ وَالْأَرْضَ لَهُمَا
