(وَإِنْ شَرَطَ) مُقْرِضٌ (رَدَّهُ بِعَيْنِهِ لَمْ يَصِحَّ) الشَّرْطُ ; لِأَنَّهُ يُنَافِي مُقْتَضَى الْعَقْدِ وَهُوَ التَّصَرُّفُ وَرَدُّهُ بِعَيْنِهِ يَمْنَعُ ذَلِكَ
