(وَتَنْعَقِدُ) الْكَفَالَةُ (بِمَا) أَيْ لَفْظٍ (يَنْعَقِدُ بِهِ ضَمَانٌ) ; لِأَنَّهَا نَوْعٌ مِنْهُ، فَانْعَقَدَتْ بِمَا يَنْعَقِدُ بِهِ

قُلْتُ: فَيُؤْخَذُ مِنْهُ صِحَّتُهَا مِمَّنْ يَصِحُّ مِنْهُ الضَّمَانُ وَصِحَّتُهَا بِبَدَنِ مَنْ يَصِحُّ ضَمَانُهُ

معونة أولي النهىIbn al-Najjar

(وتنعقد) الكفالة (بما) أي: بلفظ (ينعقد به ضمان) ، لأنها نوع منه.

فانعقدت بما ينعقد به.

وقيل: لا تنعقد بحميل وقبيل.
