(وَإِلَّا) بِأَنْ لَمْ يَتَصَالَحَا عَلَى إجْرَائِهِ فِيهِ مَعَ بَقَاءِ مِلْكِهِ (فَ) هُوَ (بَيْعٌ) ; لِأَنَّ الْعِوَضَ فِي مُقَابَلَةِ الْمَحَلِّ
