(وَكَذَا مُسَاقَاةٌ وَمُزَارَعَةٌ) فَلَا يَصِحَّانِ إنْ شُرِطَ لِعَامِلٍ جُزْءٌ مَجْهُولٌ أَوْ آصُعٌ مَعْلُومَةٌ أَوْ ثَمَرَةُ شَجَرَةِ مُعَيَّنَةٍ أَوْ مَجْهُولَةٍ أَوْ زَرْعُ نَاحِيَةٍ بِعَيْنِهَا وَنَحْوِهِ
