(وَيَخْتَصُّ) كُلٌّ مِنْهُمَا (بِضَمَانِ مَا غَصَبَهُ أَوْ جَنَاهُ أَوْ ضَمِنَهُ عَنْ الْغَيْرِ) ; لِأَنَّ لِكُلِّ نَفْسٍ مَا كَسَبَتْ وَعَلَيْهَا مَا اكْتَسَبَتْ.
