(او استعمل المودع الوديعة بإذن ربها) ، كما لو أودع إنسان إنساناً عبدا وقال له: استخدمه ففعل ولا عقد بينهما: (فعارية) أي. فحكمها حكم ما لو قال: أعرتكها، وقال الآخر: استعرتها.
