(وَإِنْ حُفِرَ نَهْرٌ صَغِيرٌ وَسِيقَ مَاؤُهُ مِنْ نَهْرٍ كَبِيرٍ مَلَكَهُ) أَيْ: مَلَكَ الْحَافِرُ الْمَاءَ الدَّاخِلَ فِيهِ

وإلى ذلك أُشير بقوله: (وأن حُفر نهر صغير وسبق ماؤه من نهر كبير: مُلك) أى فيصير حافره مالكاً للماء الداخل إليه وقراره وحافتيه بأنتهاء الحفر إلى قصده.
