(وَمَعَ رِقٍّ مُلْتَقَطٍ وَإِنْكَارِ سَيِّدِهِ) أَنَّهَا لُقَطَةٌ (فَلَا بُدَّ مِنْ بَيِّنَةٍ) تَشْهَدُ بِأَنَّهُ الْتَقَطَهَا وَنَحْوَهُ ; لِأَنَّ إقْرَارَ الْقِنِّ بِالْمَالِ لَا يَصِحُّ .
