(وَلَا يَنْقَطِعُ نَظَرُهُمَا) أَيْ: الْحَكَمَيْنِ (بِغَيْبَةِ الزَّوْجَيْنِ) أَوْ غَيْبَةِ (أَحَدِهِمَا) ; لِأَنَّ الْوَكَالَةَ لَا تَنْقَطِعُ بِغَيْبَةِ الْمُوَكِّلِ

معونة أولي النهىIbn al-Najjar

(ولا ينقطع نظرهما) أي: نظر الحكمين (بغيبة الزوجين أو أحدهما) عن بلد الحكمين على الأصح؛ لأنهما وكيلان، والوكالة لا تنقطع بغيبة الموكل.
