(وَإِلَّا) يَكُنْ سُؤَالٌ وَلَا بَذْلُ عِوَضٍ (فَلَا بُدَّ مِنْهَا) أَيْ: النِّيَّةِ (مِمَّنْ أَتَى بِكِنَايَةِ) خُلْعٍ كَطَلَاقٍ وَنَحْوِهِ.
