(وَإِلَّا) تَقْبَلْ ذَلِكَ بِالْمَجْلِسِ (وَقَعَ) الطَّلَاقُ (رَجْعِيًّا) نَصًّا ; لِأَنَّهُ اشْتَرَطَ الْعِوَضَ عَلَى مَنْ لَمْ يَلْتَزِمْهُ فَلَنَا الشَّرْطُ

(وإلا) أي: وإن لم تقبل ذلك بالمجلس: (وقع) الطلاق (رجعياً) على المنصوص؛ لأنه طلاق شرط فيه العوض على من لم يلتزمه، فلغا الشرط ووقع الطلاق رجعياً.
