شرح منتهى الإراداتal-Buhuti

(لَا) يَصِحُّ (تَعْلِيقُهَا) أَيْ الرَّجْعَةِ (بِشَرْطٍ ك) قَوْلِهِ لَهَا (كُلَّمَا طَلَّقْتُكِ فَقَدْ رَاجَعْتُكِ) لِمَا سَبَقَ

معونة أولي النهىIbn al-Najjar

(ولا تعليقها) يعنى: أنه لا يصح تعليق الرجعة (بشرط؛ كـ) قوله لزوجته: (كلما طلقتك فقد راجعتك) ، لأن الرجعة استباحة بضع مقصود. فلا يصح تعليقها بشرط " كالنكاح.
