(فَلَوْ أَعْسَرَ مُوسِرٌ قَبْلَ تَكْفِيرٍ لَمْ يُجْزِئْهُ صَوْمٌ) لِأَنَّهُ غَيْرُ مَا وَجَبَ عَلَيْهِ وَتَبْقَى الرَّقَبَةُ فِي ذِمَّتِهِ إلَى يَسَارِهِ كَسَائِرِ مَا وَجَبَ وَعَجَزَ عَنْ أَدَائِهِ
