(وَيُعَزَّرُ) زَوْجٌ (بِقَذْفِ زَوْجَةٍ صَغِيرَةٍ أَوْ) مَجْنُونَةٍ (وَلَا لِعَانَ) لِمَا تَقَدَّمَ وَلِأَنَّهُ يَمِينٌ فَلَا يَصِحُّ مِنْ غَيْرِ مُكَلَّفٍ.

معونة أولي النهىIbn al-Najjar

(ويعزر) الزوج (بقذف زوجة صغيرة أو مجنونة، ولا لعان) يشرع بينهما؛ لأنه قول تحصل به الفرقة المؤبدة فلا يصح من غير مكلف، أو يمين.

فلا يصح من غير مكلف؛ كسائر الأيمان.
