(فَتَجِبُ) النَّفَقَةُ (لِصَحِيحٍ مُكَلَّفٍ لَا حِرْفَةَ لَهُ) ; لِأَنَّهُ فَقِيرٌ.

الشَّرْطُ الثَّالِثُ أَنْ يَفْضُلَ مَا يُنْفِقُهُ عَلَيْهِمْ عَنْ حَاجَتِهِ وَإِلَيْهِ الْإِشَارَةُ بِقَوْلِهِ
