(ولا ينفذ) ضبطه العيني بالتشديد وليس بمتعين (قول المطلوب على الكفيل) لأنه إقرار على الغير مثل مالك عليه ما أقر لك به أمس

فلو قال المطلوب: أقررت له بألف أمس لم يلزم الكفيل قيد بما له عليه لأنه لو قال: بما ذاب أي حصل أو ثبت له عليه فأقر المطلوب بمال لزم الكفيل، والفرق أن الكفالة بما له عليه كفالة

فلو قال بالدين القائم في الحال وبما ذاب ونحوه بما يسحب والوجود يثبت بإقراره.

ولو قال: ما قضى لك به لا يلزم إلا أن يقضي، وسيأتي ما لو غاب المكفول فبرهن الطالب عن الكفيل
