(وَيُسْتَحْلَفُ الْمُقَرُّ لَهُ فِيهِمَا) بِخِلَافِ مَا لَوْ أَقَرَّ بِالدَّرَاهِمِ السُّودِ فَكَذَّبَهُ فِي صِفَتِهَا يَلْزَمُهُ مَا أَقَرَّ بِهِ فَقَطْ كَإِقْرَارِ الْكَفِيلِ بِدَيْنٍ مُؤَجَّلٍ وَلِمَنْ عَلَيْهِ دَيْنٌ مُؤَجَّلٌ إذَا خَافَ لَوْ اعْتَرَفَ بِهِ لَا يُصَدِّقُهُ إنْكَارُ أَصْلِ الدَّيْنِ إذَا لَمْ يَرُدَّ تَوِيَ حَقُّهُ وَمَنْ أَقَرَّ بِعَدَدٍ مُبْهَمٍ وَعَطَفَ مَوْزُونًا أَوْ مَكِيلًا كَانَ بَيَانًا لَهُ
