(وَإِنْ اُحْتُمِلَ عَوْدُهُ إلَيْهِ لَا) يَعْنِي لَا يَكُونُ مَوَاتًا لِتَعَلُّقِ حَقِّ الْعَامَّةِ فِيهِ عَلَى تَقْدِيرِ رُجُوعِ الْمَاءِ إلَيْهِ؛ لِأَنَّ الْمَاءَ حَقُّهُمْ لِحَاجَتِهِمْ إلَيْهِ اهـ.
